Welcome to the Highline SmartTown WiFi Service (the "Service"). By accessing or using this service, you agree to comply with these Terms of Service and Acceptable Use Policy ("Terms"). Please read this document carefully. If you do not agree to these Terms, please disconnect from the Service immediately.
1. Service Overview
Highline provides free public WiFi to existing customers or established partnerships for the convenience of users (“Users”). Access to the Service may also be provided through special access methods, such as QR codes that are issued at Highline's sole discretion for limited-time use. These methods are non-transferable and subject to all provisions of this policy.
The Service is offered on an “as is” and “as available” basis, without warranties of any kind.
Users are responsible for ensuring their devices and activities comply with these Terms.
2. Acceptable Use Policy
A. Eligibility for Use
- The Service is exclusively available to Highline customers in good standing who have an active account with Highline.
Users may also be granted access to the Service on a temporary basis through special access methods, such as event-specific QR codes that are issued at Highline's sole discretion for limited-time use. These methods are non-transferable and subject to all provisions of this policy.
Access to the Service is not intended for the general public unless explicitly authorized by Highline.
Age Restriction: The Service is not intended for use by individuals under the age of 13. By using the Service, you represent and warrant that you are at least 13 years old. Users under the age of 13 are strictly prohibited from accessing or using the Service. Highline does not knowingly collect or store personal information from individuals under the age of 13. If it is discovered that a user under the age of 13 has accessed the Service, Highline reserves the right to immediately terminate their access and delete any associated data.
Responsibility of Parents or Legal Guardians
Parents or legal guardians who permit minors under their supervision to use the Service, even though the Service is intended for users aged 13 and older, assume full responsibility for:
The minor's activities on the Service.
Ensuring compliance with these Terms and any applicable laws or policies.
Highline will not be liable for any consequences arising from unauthorized use of the Service by minors.
B. Prohibited Activities
Users agree not to use the Service to:
Engage in any unlawful activity, including but not limited to:
Violating local, state, national, or international laws, treaty, court order, ordinance, regulation, or administrative rule.
Distributing or accessing child pornography or other illegal content.
2. Infringe on intellectual property rights, including downloading or sharing copyrighted material without authorization.
3.Harm, harass, or threaten others.
4. Conduct network security violations, such as:
Attempting unauthorized access to systems or data.
Spreading malware, viruses, or other harmful software.
Engaging in phishing, spamming, or fraudulent activity.
5. Interfere with the performance of the Service or other users' access, such as excessive bandwidth usage or denial-of-service attacks.
6. Use the Service to access inappropriate content including adult content, gambling sites, or other material deemed offensive or unlawful.
7. Resell the Service or permit the use of the Service by any unauthorized users.
C. User Responsibilities
Device Security: Users must take reasonable precautions, including enabling firewalls and using antivirus software when necessary.
Personal Data Protection: Highline is not responsible for the security of any personal data transmitted over the Service.
Secure Use of the Service: While the Service is operated on a secure network enhanced by ProtectIQ and ExperienceIQ to safeguard user activity, Highline advises users to exercise caution when conducting sensitive transactions, such as online banking or entering personal information, over any shared network. For added protection, users should enable personal device security measures, such as firewalls to ensure their data remains private even in a multi-user environment.
Adherence to Highline’s Internet Use Policies: By accepting these Terms, users also acknowledge and agree that access to the Wi-Fi service is restricted to authorized Highline customers and users with temporary access permissions. Users further agree to comply with Highline’s standard internet service Acceptable Use Policies, as outlined in the Highline™ Acceptable Use Policies.
D. Monitoring and Cooperation with Law Enforcement
Eligibility Verification: Highline reserves the right to verify a user’s eligibility to access the Service, including checking account status for regular customers, age verification, or verifying event access for users that do not have Highline accounts.
Highline reserves the right to monitor all network traffic and usage logs to enforce compliance with these Terms and applicable laws and regulations.
Usage logs may include, but are not limited to, IP Addresses, device identifiers, MAC addresses, session timestamps, and bandwidth consumption. These logs are retained in accordance with applicable data retention laws and may be shared with law enforcement as required.
3. Terms of Service
A. Use of Service
Permissible Use: The Service is intended for use by Highline customers or users granted access through approved methods for casual internet browsing and lawful activities.
Session Limits: Sessions may be time-limited to optimize network usage.
Bandwidth Allocation: Bandwidth usage may be capped to ensure fair access for all users.
Non-commercial and Authorized Commercial Use: The Service is provided primarily for personal, non-commercial use unless expressly authorized in writing by Highline. Commercial use is prohibited except for businesses or partners explicitly authorized by Highline in writing. In such cases, where authorized commercial subscribers are provided access, their customers may also use the Service as permitted under the terms of Highline's agreement with the business subscriber.
For the purposes of this Agreement, "commercial use" includes, but is not limited to:
Operating any aspect of a business using the Service;
Hosting, sharing, or distributing the Service or its components for purposes outside of personal use;
Using the Service to support business operations, including but not limited to communication, data storage, or processing for profit or in connection with a business;
Offering the Service or access to it as part of any commercial arrangement, subscription, or other monetized offering;
Engaging in any activity that monetizes the Service, directly or indirectly, without prior authorization from Highline.
Highline reserves the right to determine, at its sole discretion, whether a user’s activity constitutes prohibited commercial use. Unauthorized commercial use of the Service is a violation of this Agreement and may result in immediate termination of access, as well as additional legal action.
5. No Guarantee of Privacy or Security
Users acknowledge that while the Service's network is designed to enhance security using tools such as ProtectIQ and ExperienceIQ, it is still shared by multiple users.
Highline does not guarantee the confidentiality or integrity of data transmitted over the network. Users are encouraged to use additional security measures for sensitive transactions.
B. Liability Disclaimer
Highline is not liable for:
Data breaches, malware, or other security incidents.
Service interruptions or errors.
Loss or theft of data during Service use.
THE SERVICE IS PROVIDED “AS IS,” AND HIGHLINE DISCLAIMS ALL WARRANTIES,
EXPRESS OR IMPLIED.
3. Users are solely responsible for ensuring the security of their devices and data when using the Service. Highline disclaims all liability for any unauthorized access, data breaches, or malicious activities conducted on or through the Service.
4. WITHOUT LIMITING THE FOREGOING, ABSENT HIGHLINE’S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, USER RELEASES HIGHLINE FROM LIABILITY FOR ANY LOSSES OR DAMAGES THAT USER MAY SUSTAIN AS A RESULT OF ACCESSING OR USING THE SERVICE (OR ITS INABILITY TO ACCESS OR USE THE SERVICE).
4. Enforcement
Violations of these Terms may result in the immediate termination of Service access.
Highline reserves the right to block or restrict access to specific devices or activities to protect the network and other users.
Highline may take enforcement actions as deemed appropriate, including disabling users' ability to connect to the Service, or limiting access to specific websites or services.
5. Indemnification
Users agree to indemnify, defend, and hold harmless Highline, its affiliates, employees, officers, and agents from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising from:
Any violation of these Terms by the User or any other person accessing the Service through the user's account, device, or as a result of the User’s consent;
The placement, transmission, or use of any materials, data, or content on or through the Service by the User or any other person accessing the Service through the User's account, device, or as a result of the User’s consent;
Any third-party claims, demands, or actions alleging:
Infringement of intellectual property rights, privacy rights, or any other legal rights due to the User’s activities;
Harm or damage caused to third parties resulting from the User's use of the Service; or
Violations of any applicable laws or regulations by the User.
This indemnification obligation will survive the termination of the User's access to the Service and any agreement between the User and Highline regarding the Service. Highline reserves the right to assume the exclusive defense and control of any matter subject to indemnification, in which case the user will cooperate with Highline in asserting any available defenses.
6. Modifications to Terms
Highline reserves the right to update or modify these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.
7. Redress and Governing Law
A. Resolution of Disputes – Arbitration
Any dispute or claim between you, the User, and Highline arising out of or relating to the Service provided under these Terms (including the Acceptable Use Policy included herein) shall be resolved exclusively through binding arbitration before a single arbitrator, with such arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules and to take place in Wilmington, Delaware (“Arbitration”).
The arbitrator’s decision shall be based on the plain meaning of the applicable documents, and the decision shall be final and binding. The arbitrator shall have no authority to: (i) award relief in excess of what is provided under these Terms; or (ii) award punitive or exemplary damages. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction. All claims must be arbitrated on an individual basis; Users agree not to bring, join, or participate in any class action or consolidated claims in court or arbitration. USERS ACKNOWLEDGE THAT THIS ARBITRATION PROVISION WAIVES ANY RIGHT TO A JURY TRIAL.
B. Resolution of Disputes – Governing Law
These Terms and the relationship between you and Highline shall be governed by the laws of the state of Delaware without regard to its conflict of law provisions. To the extent court action is initiated to enforce an arbitration award or for any other reason consistent with the Arbitration provision herein, you and Highline agree to submit to the personal and exclusive jurisdiction of the courts located within the state of Delaware and waive any objection as to venue or inconvenient forum. The failure of Highline to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or these Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred.

Important Notice:
Highline reserves the right to suspend or terminate access to this Service at its sole discretion if the network is used in violation of these Terms or applicable laws.
